(1) According to rule 36, if the user group that takes charge of the conservation community forest does not act in accordance with the forest management action plan, the council shall request an explanation from such committee within fifteen days.
(2) If the explanation demanded according to sub-rule (1) is not given or if the explanation given is not satisfactory or if it appears from the on-site report that it is desirable to withdraw the conservation community forest, the council may withdraw such forest. Unless there is another arrangement for the protection of the community forest withdrawn in this way, the council can have it protected and managed by itself or through a consumer group.
(3) A group that is not satisfied with the decision made by the council according to sub-rule (2) may file a complaint with the department within thirty five days of receiving the notice of such decision.
(4) If a complaint is filed according to sub-rule (3), the department shall give its decision and the decision given by the department shall be final.
(5) In the case of a complaint filed under sub-rule (3), the Forest Protection and Management Council itself will do so until the final decision is reached.
